Terms and Conditions of Service

By opening and using your VIP Communications prepaid calling account, you agree to the following Terms and Conditions of use. If you do not agree with all Terms and Conditions, please call Customer Service before using your account again.

All references to "VIP Communications" below are references to VIP Communications, Inc.

1. In order to protect access to the customer's account from unauthorized persons, the customer:
   a. Shall take care not to disclose account or PIN numbers to another person, other than an authorized operator or technician employed by an approved telecommunications company for the purpose of programming software or equipment to access the VIP Communications system, or an employee or person authorized by VIP Communications and;
   
   b. Shall change the PIN number from time to time, or when the customer suspects the possibility of unauthorized present or future use of the account. In the case of suspected unauthorized use, the customer should inform VIP Communications immediately.


2. The customer agrees and undertakes:
   a. To use the service in accordance with such conditions as may be varied by VIP Communications by notice posted on our internet web page at www.joinvip.com from time to time.
   
   b. Not to use or permit to use the VIP Communications network or services for any purpose not permitted by law.


3. The customer shall indemnify VIP Communications against all liabilities, claims, damages, losses and expenses arising from any breach of the customer’s undertakings in 2(a) and 2(b) above.


4. VIP will use its reasonable endeavors to provide its telephone service to the customer. However when VIP is unable to provide its service to the customer, the customer is free to utilize another telecommunications service until access to VIP is reinstated. VIP will not be held liable for ANY charges or damages to the customer should the customer be prevented from accessing the VIP telephone system.


5. Neither party shall be liable to the other in contract, tort, or otherwise for any loss of business, contracts, anticipated savings or profits or for any other indirect or consequential loss whatsoever.


6. Disclosure of account details to persons other than authorized employees of VIP Communications is entirely at the customer’s risk.


7. The customer shall be liable for all charges and fees arising from use of the account whether authorized or unauthorized, unless such unauthorized use is solely attributable to an act or omission on the part of VIP Communications.


8. Usage charges will be at the rates shown on the VIP internet web site price list and are subject to change without prior notice. Such changes will be posted on the web site.


9. Call duration will be rounded to the next full minute and will be billed in one (1) minute intervals.


10. Prices include all applicable federal, state, and local taxes that may be due on the service provided. VIP will remit to the appropriate body any and all taxes legally due on services provided to its customers.


11. Any approved refunds, will be made in the manner in which the original payment was made. VIP reserves the right to use an alternative method of refund where necessary.


12. VIP reserves the right to close a customer’s account for any reason, and will return any unused units present at that time.


13. VIP reserves the right to terminate any account left unused for a period of 182 days and any units left therein will then expire and will be refundable solely at VIP’s discretion.


14. A $25 fee will apply for any returned check . A $25 fee will apply for any erroneous credit card chargeback.


15. To qualify for a referral bonus, the referring party’s and referred party’s accounts must both be eligible for the bonus. The referred party must not be a current or previous VIP customer. Referral bonuses are only payable once the referred party has opened an account for at least $25. Referrals where both the referrer and referee live at the same address or use the same credit card account are not eligible for any referral bonus. VIP reserves the right not to fulfill any referral bonus offer if it believes that the applicant is associated with a pre-existing account.


16. In order to qualify for any sign-up bonus offered by VIP, the recipient must not be an existing or a previous customer of VIP and must not use the same credit card or live at the same address as any existing or previous customer of VIP. VIP reserves the right not to fulfill any sign-up bonus offer if it believes that the applicant is associated with a pre-existing account.


17. All bonus or other free credit offers from VIP are redeemable only as a credit into the customer’s VIP calling account. No cash or other substitutes.


18. Any refund or transfer request for an outstanding money balance on a customer’s account will be subject to a deduction up to the full amount of any free credit previously placed on the account. For the purposes of calculating the customer’s refundable balance, VIP will consider the usage of the account balance in the following order:
    • Customer credit
    • Free bonus credit


19. A $5 administration fee will apply to any refund made to a customer. VIP will calculate the available balance using the formula stated above. The administration fee of $5 will then be deducted from this balance. Where the available balance is less than $5, no refund will be due.


20. These terms and conditions also relate directly to other services offered by VIP which may be accepted by the customer at a later date.


21. These terms shall be governed in accordance with the laws of the Commonwealth of Virginia, and the customer irrevocably submits to the jurisdiction of the Commonwealth of Virginia.
